LEGAL INFORMATION - CONTRACT

WINDOW FILM – TERMS AND CONDITIONS

Please take time to read the following in its entirety to completely understand the terms and conditions of essential factors when dealing with the purchase and maintenance of the window film material. You are solely responsible for reviewing our terms and conditions prior to submitting a request to have work performed. We will begin work when approval has been provided per the completion and signature of our Customer Information Sheet and any additional requested documents.

ACCURACY OF SPECIFICATIONS: Estimates are based on the accuracy of the specifications provided to us by you, the customer. If we discover after accepting the job   that modifications need to be made, we will notify you immediately, at which time a decision will be made on whether there will be additional costs and how you wish for us to proceed. Any verbal requests or orders by the customer will be accepted, but in the absence of supportive documentation, Blue Knight Tinting will not be responsible for verbal mistakes.

EVERYTHING MUST BE IN WRITING; Blue Knight Tinting will not accept responsibility for the inaccuracies in orders telephoned in by the customer. We make every effort to quote a job accurately; but in the event of unforeseen circumstances or costs, we will notify you if there will need to be cost adjustment or if delays will result.

​GENERAL TERMS AND CONDITIONS, TERMS OF PAYMENT, LEGAL FEES, AND DISPUTES: The customer agrees to make full payment prior to the release of the products. The products will not be released until full payment has been processed accordingly. Any invoice that is not paid at the time of order or delivery is considered past due and the customer is responsible for all collection fees including but not limited to attorney fees and court costs for unpaid balances at the interest rate of 18% per annum. This is not an expectation contract and we are not responsible for buyers’ remorse. By accepting the product, you are accepting the job as complete and that the performance is satisfactory.

 You are responsible for inspecting the product upon receipt. Customers shall identify to Blue Knight Tinting in writing any dispute concerning an invoice within five days of the date of the invoice. If disputes are not identified in writing within the five-day time frame the customer has accepted the job and the invoice. Customers must contact Blue Knight Tinting of any and all work in dispute, accompanied by a written explanation. After investigation, if an error is found on our behalf, we will make appropriate corrections.

Blue knight tinting strictly a window film sales and installation company. Blue Knight Tinting is not required to move furniture, blinds, equipment, and or other obstacles that may affect the installation of the window films for your project. Clients are encouraged to clear such obstacles prior to installation or please make the necessary arrangements ahead of time with Blue Knight Tinting. You may be charged additional money for the additional time.

 

​ It is the client’s responsibility to read our Terms & Conditions available on our website prior to contacting Blue Knight Tinting to perform any services. All quotations are valid for 30 days.

​PAYMENT TERMS: Customer or assigned agent completing the Customer Information sheet agrees that they are the responsible party for payment of services requested. The customer or assigned agent agrees to make full payment prior to vehicle release and agrees to be responsible for all collection fees including attorney fees and court costs for any unpaid balances at the interest rate of 18% per annum. Any ordered materials for the customer’s job are required to be paid for 100% prior to the order for the film before the work will be performed and is non-refundable. Any custom ordered window film for any project is paid for by the customer 100% prior to ordering the product.

WE DO NOT ACCEPT CHECKS unless they are paid via certified bank funds and are pre-approved in writing by Blue Knight Tinting. Any request changes to the description of services stated above need to be in writing and any additional charges incurred will be charged accordingly. The customer will pay the remaining balance including any additional cost or fees upon completion of the job prior to the release of the vehicle.

​CONDITION OF GLASS PRIOR TO WINDOW FILM INSTALLATION: A cleaning charge of $100.00 per hour will be assessed for any removal of existing window film material.

Blue Knight Tinting is not responsible for the condition of the surface the glass. Any existing scratches, cracks, or other damage will be visible through the film, and such surface damage or imperfections may damage the film, cause the film to fail prematurely or the window film material may not adhere to the surface at all. We are not responsible for broken windows if there is prior damage prior to installation. WE ARE NOT RESPONSIBLE FOR THE CONDITION OF THE GLASS PRIOR TO THE WINDOW FILM BEING INSTALLED OR WHAT IS UNDERNEATH THE WINDOW FILM ONCE IT IS INSTALLED. There is always the chance of contamination to the film when installed and all measures will be made to reduce this, however, 100% contamination-free installation is not made for the installation.

​RETURNS: Window film material is a non-returnable item once the material is ordered, cut, and or installed per the customer’s personal request. Any custom ordered window film for any project is paid for by the customer 100% prior to ordering the product. If the job is canceled or the customer does not want the product for any reason the film cost is non-refundable. All returns are at the discretion of Blue Knight Tinting. If the product is a returnable item there is a 25% restocking fee for the return and will be deducted from the initial cost of the product upon the return if applicable. If an issue arises the customer must submit their complaint in writing and give Blue Knight Tinting the opportunity to see the issue and try and resolve the issue prior to pursuing any legal actions.

Since all window film installations are customized to the customer's specifications Blue Knight Tinting must be given the opportunity to address any issues, including removal and reinstallation, before the client issues a credit card chargebacks or check cancellations. In the event that the client does request a credit card chargeback or check cancellation, the customer will be liable for all legal fees and or additional costs that were incurred to Blue Knight Tinting. If a credit card dispute is decided in the favor of Blue Knight Tinting and we suffer any losses due to the client’s actions the client is liable for all legal fees, court costs, etc. If the customer fails to make full payment on an invoice, then the customer authorizes Blue Knight Tinting to remove the window film from the windows if installed.

 

SINCE WINDOW FILM IS CUSTOM INSTALLED TO THE CUSTOMER'S SPECIFICATIONS ONCE THE FILM IS CUT AND OR INSTALLED ALL CONTRACTS ARE FINAL AND NO MONETARY REFUNDS WILL BE ISSUED.

​ESTIMATES: Estimates are good faith estimates and are based on the current information Blue Knight Tinting has at the time the estimates are given. Estimates given are good for 30 days and are subject to change.

​CONTENT: We reserve the right to refuse any work or vehicle for any reason.

​INSTALLATIONS: Window film is a pliable material that is made to be installed on glass. We make every effort to make look as clean and seamless as possible, however, there may certainly surfaces that window film will not adhere to such as plastic, rubber, dot matrix, etc., and customers are not advised to install on such areas. If the customer requests that these areas be installed, we are not responsible for the material not sticking or adhering to those surfaces and the manufacture will not warranty such items.

Per the IWFA (International Window Film Association) The glass with applied films shall be viewed at right angles to the glass from the room side and at a distance no less than six (6) feet. Viewing shall be carried out in natural daylight, not in direct sun light. The installation is deemed acceptable if all of the following are unobtrusive (effects during 30–60-day cure time should be disregarded). Dirt Particles, Hair and Fibers, Adhesive Gels, Fingerprints, Air Bubbles, Water Haze, Scores and Scratches, Film Distortion, Creases, Edge Lifting, Nicks and Tears. If any of these conditions still exist after 30-60 days, we request the customer have us evaluate the film.

​WE CAN NOT DO AN INSPECTION OVER THE PHONE, VIA EMAIL, OR THROUGH PICTURES; WE MUST SEE THE GLASS FOR INSPECTION.

Safety & Security Film

Safety & Security film is a polyester film that relies on thickness to mitigate hazards from shattered glass due to natural and human causes. Due to the film’s thickness, minor imperfections are more noticeable than standard films while also increasing cure times. The client understands there will be minor imperfections in and under safety and security film installations and holds Blue Knight Tinting harmless in such instances.

Anti-Graffiti & Surface Protection Films

Many Surface protection films are thick to help mitigate vandalism and/or unsightly wear and tear. Due to the film’s thickness, minor imperfections are more noticeable than standard films, and also increases the curing time. The client understands there will be minor imperfections in and under Surface protection film installations and holds Blue Knight Tinting harmless in such instances. Any security film installed by another tinter, or by the homeowner/business owner, or employee of said business/home, and this film/tint has to be removed before new film/security film has to be installed, Blue Knight Tinting will not be responsible for the condition of the glass (or glass failure) to being applied to, and any negative outcome (or glass failure) of the film applied to, Blue Knight Tinting will not be held liable for that install outcome. This applies to graffiti film as well.

Privacy Film

Privacy film can be subtle to bold as the film goes from translucent to opaque. The matte, blackout, and mirror films limit views through glass on the building interior. Blackout/Opaque film provides the ultimate in privacy. Translucent films provide subtle privacy with enhanced aesthetics. Dark colored film will be difficult to view-through during daytime lighting conditions from the exterior, but in darker nighttime conditions and with an interior light source, privacy is lost as the light from the inside allows for visibility from the outside. The client understands these limitations as there are no refunds upon completion of such application.

Solar Film

Solar and Energy efficient films are available in different shades ranging from virtually clear 70% to a dark 5%. The Client understands that there are no refunds once film shade is selected and installed.

Decorative & Frosted Film

Used for interior decor or privacy, the Client understands that there are no refunds once a pattern is selected and installed.

 

 

 

 

Equipment

The client understands that additional charges may be incurred to acquire specialized installation equipment to install window film such as scaffolding, scissor lifts, and etc. for your project.

Window Cleaning

Blue Knight Tinting is solely responsible for cleaning the side of the windows that are being serviced. Blue Knight Tinting is not required to clean the exterior windows of a completed interior installed project.

Glass Breakage

The Client understands that choosing to install window film outside of recommended specs may increase the stress factor of a glass and can result in glass breakage.

Light Gap

All installed window films are cut at the edge of a window’s trim. The Client understands that there will be light gap between the film and trim which is easier to see it when film is darker. A gap is present to allow water seepage during the install and for the expansion and/or contracting of the glass due to climate changes.

This also ensures that the film edges are not raised up by contact with the frame margin, dot matrix, or other moldings, etc. Contact with the frame, dot matrix or moldings can lead to the peeling of the film. A gap may also exist due to the type of glass or windows that the film is installed on, which Blue Knight Tinting is not responsible for.

Imperfections

Though we strive for perfection in our installations, there will be some degree of dust contamination and/or minor imperfections that are present in every window film application due to working environment and conditions out of our control. The Client understands such conditions exist as well as pre-existing flaws or scratches on glass that may become noticeable post installation. Older homes or buildings tend to have more imperfections due to age.

 

 

ONCE INSTALLED WINDOW FILM MATERIAL IS INTENDED TO BE VIEWED FROM A DISTANCE OF SIX (6) FEET FROM THE GLASS AND IS DEEMED AS ACCEPTABLE.

​WINDOW FILM COMES IN MANY DIFFERENT SHADES, COLORS, AND OPTIONS AND IS SELECTED SOLEY BY THE CUSTOMER AND IS INSTALLED AT THEIR REQUEST. BLUE KNIGHT TINTING IS NOT RESPONSIBLE FOR THE CUSTOMER's CHOICE IN FILM SELECTION OR FOR BUYER's REMORSE.

​Installation time is based upon many factors including but not limited to, film selected, curing time, places where window film is being installed, size of windows, size of the vehicle, the complexity of installation areas, and any unforeseen circumstances that may arise. We will make every effort to give reasonable time frames for installation but reserve the right to change them at any time for any reason.

​In most cases, bubbles and haziness will subside in the 30–60-day cure time. We DO NOT require a 30–60-day check-up for window film. However, if you see any areas of concern, please advise us. If you do not advise us within the 30-60 day required time frame to address any issues, we are not responsible for the condition of the window film material or any installation issues. Blue Knight Tinting is the installation company only we are not the manufacturer.

​REMOVALS: All removals for window film are quoted separately and are based on a per-hour basis. Window film removal can be very time-consuming and costly and is billed as such. Blue Knight Tinting is not responsible for the condition of the glass underneath the film being removed or for any damage that occurs when such material is removed from the glass. Blue Knight Tinting is not responsible for any damage that occurs to the glass at the owner’s request.

​WARRANTY AND MATERIALS: All materials are installed per the customer or authorized representative’s request. We are not the manufacturer of the product and all warranties are offered through the manufacturer of the product the customer specifically ordered. For warranty information, you must visit the manufacture's website or brochure for specific information regarding the product(s) you ordered. Blue Knight Tinting is the installer of the product, not the manufacturer. However, if there is something wrong with the product our manufacturers do stand behind their products as do, we, so please do not hesitate to contact us. Damage done to the film by the customer or any third party is not a warranty issue and will not be covered as such. Blue Knight Tinting is not liable for services that are contracted out to other facilities for work to be performed. If an issue arises the customer must contact that specific company directly for any warranty issues or concerns regarding that company’s product or services.

Commercial, Security and Decorative Window Films sold and installed by Blue Knight Tinting **DO NOT** carry a lifetime warranty. Most Residential Solar control films sold and installed by Blue Knight Tinting carry a lifetime warranty covering bubbling, peeling, and delamination. Commercial film sold and installed by Blue Knight Tinting will carry a 7–15-year warranty covering bubbling, peeling, and delamination. Please ask for the specific warranties related to your project as each window film company has limits on their warranties.

 

​AFTERCARE: You will see bubbles and haziness (the moisture between the glass and the film) in the windows until the film has fully cured. This can take 30-60 days depending upon the type of film you select and the environment. Avoid using abrasive washing clothes as well as drying towels when cleaning the film. Do not use any ammonia-based products to clean the film, only use tint-safe products.

​CHANGES/CORRECTIONS/ERRORS: We reserve the right to correct inaccuracies, prices, omissions, descriptions, and errors relating to products, productions, availability, and update information at any time without prior notice.

​ENTIRE AGREEMENT: This agreement may not be varied other than in writing, executed by the duly authorized representative of both parties. Clients and or authorized representatives acknowledge that they have read and understood the terms and conditions and agree to accept these prices, fees, charges, conditions, and specifications listed herein and authorize Blue Knight Tinting to perform all work as specified. The customer understands that we are not the manufacturer of the products and that we do not guarantee the quality of the products provided to us by the manufacturer.

​The customer or assigned agent agrees not to do harm to Blue Knight Tinting by way of slander, via in-person, over the phone, in writing (published words), or by instructing others to do so as well. Any published statements made by a customer or its assigned agent must be approved by Blue Knight Tinting prior to publication. In the event of any dispute, claim or controversy arising out of or relating to the information described in these Terms & Conditions all parties agree to resolution by Mediation/Binding Arbitration.

 The Mediation/Binding Arbitration will be administered in New Jersey (or state where installed) pursuant to comprehensive mediation and arbitration rules and procedures. If a customer or assigned agent takes legal action against Blue Knight Tinting for any of the information contained in this agreement the customer or assigned agent agrees to bear all legal fees and court costs.

​The validity and enforceability of this agreement will be interpreted in accordance with the laws in the state of New Jersey (or state where installed) applicable to agreements entered into and services performed in the state of New Jersey (or state where installed). If we must retain attorneys for any reason, we will be entitled to reasonable attorney’s fees, court costs, administrative fees, and interest at the maximum rate permitted by law.

​ Deposit / Order Cancellation

A 50% non-refundable deposit of your estimate or, full material cost is due upon signing of this; either electronically (ach, cc, PayPal, Venmo, Zelle, etc.). Deposits will be applied to final cost which is due in full upon completion of services. Customer may cancel an order only with Blue Knight Tinting’s written consent. In the event of an approved cancellation, and where Blue Knight Tinting has incurred costs and expenses that cannot reasonably be recovered through sale of the Products to another person or entity, Customers will pay Blue Knight Tinting for all such costs and expenses, which may include costs of related raw materials, packaging, and other items dedicated to products.
